First rule of fraud - no emails. Voice calls have no written record unless recorded. if this goes to the courts, which I think that is probably where this is all heading, they want no records of these discussions. Memories get fuzzy with time and a good attorney can plant that "reasonable doubt" when staffers are questioned or give depositions weeks, months, or years from now. If you are a staffer, administrator, or even a student, I would start making some notes in regards to who said what, when, and any information that might be valuable or important as the sh-- hits the fan in the coming months. I am surprised that the feds have not been to a judge to get a warrant or an order to go into each campus to seize and preserve any evidence or records. With the lack of or perceived lack of communication or direction from corporate., the random sending of staff home, and the reports of unlocked unattended campus buildings, I would be very concerned about FERPA violations, exposure of student personal data, or massive Enron-style shredding parties.

Tell the staff to go home, take your personal belongings, and wait until you are told to come back makes the conspiracy theorist in me think that management does not want anyone around this weekend. Labor day weekend, everyone is either getting the last blast of summer in, watching college football or having fun eith their families. In the media most of the A-Team reporters have the weekend off before the final push to the November election begins. Meanwhile the corporate evidence destruction team slips in to each campus and removes the evidence before Tuesday. I know nothing on how your records are stored and who has access, want to help the kids out and possibly put the corrupt management in prision, keep an eye on the campus and tip off the FBI or Justice department if the shenanigans begin.

I started to think about reasons why they are delaying any action, the needed time to try cover their tracks and possibly relocate to an island country that does not have an extradition treaty with the US. Along the same line of thinking; why did the FBI release the Clinton email report late today? They are hopping that not as many people will pay attention.

If they file bankruptcy you can kiss the Warn Act goodbye. Business closures under bankruptcy are exempt from the Warn Act. You've received all you are going to from ITT.

WARN Act exceptions do not apply. ITT has been out of ACICS compliance for two years.

I would think they'd claim exemption from WARN under either a) Faltering Company, or b) unforeseeable business circumstances...the 30 days to find the cash won't expire for a while, so they could say they've been hoping to find a new creditor. I know, it's lame...but they certainly will try to claim it. I don't know what precedents exist on this one.

It was never warm and fuzzy. Campus employees were always trying to explain sh*t to corporate when it came to taking care of their students. Hell, the pay isn't worth the paper it's written on. I actually earned more a department store supervisor with less crappy hours. Cold and ugly to students and employees with NO notice is disgusting.

Correct it was a call, advising every single employee will receive their pay PLUS unused vacation pay in two separate checks by Tuesday. This, as stated by the corporate drone, "is a contingency plan in case the ED replies negatively." Employees were informed not to come to work Tuesday in fear of media members showing up "if the ED replies negatively." There was zero mentioned about Wednesday. There was zero mentioned about the next quarter. They advised a "letter will be sent to students." It was cold, ugly and alluded to the fact of what was going to happen.
