I finally get off severance and decide it's time to fill for unemployment. I try to file online and receive a notification that I'm not monetarily eligible for unemployment. So I call the office this morning and the lady tells me that all my wages from January and February 2016 aren't in their system. She says Devon has to pay unemployment tax on only a certain amount of wages each year and that if they chose not to pay the taxes during the first quarter of the year I wouldn't have any eligible taxes during 2016. Did Devon d--k me harder than I thought?

This is all very confusing to me and the lady I spoke with did not seem to be too interested in thoroughly explaining the process to me. Has anyone else had a situation similar to this? I can't be the only one...

Just love it when people give tax advice that shouldn't. Severance is not earned income, but it is still income. Still taxed. Why would anyone want to pay excessive taxes and draw unemployment benefits at the same time they are drawing severance benefits? Doesn't make sense at all.

Just got off the phone with unemployment. They got all my stuff sorted and like the poster below I'm good for $10,500 for 6 months.

Do not let them tell you that you're ineligible.

I had the same problem they did investigation and it was all turned out good. You will get maximum benefit for 6 months. Total unemployment in a year you can receive is $10500. Good luck process is a pain

I called HR connect and apparently a bunch of people have missing wages with the workforce commission. They are working to get it ironed out and nobody should be denied unemployment benefits because the RIF was clearly a qualifying event.

I am the OP. I got a notice from the workforce commission today stating that I have 10 days to file an appeal. I did the appeal already to find my missing wages for the first quarter or 2016.

This has been a struggle already (just communicating with the commission is a painful process) and I'm really discouraged by the possibility of not being able to collect despite having worked (paid in) for almost 20 years and never once applied to collect.

I just called and talked to someone at HRCONNECT with Devon. She confirmed that no one should be denied their unemployment benefits. You need to call and talk to her at 855-810-3555 to get your straightened out.

I dont understand how Devon can deny you your rights to receive this. Would the unemployment office not file your claim and try to fight for you to get it? There will be lots of disappointed and mad folks if this happens to everyone that hasn't filed for it yet. I had heard we had up to 18 months to file for it!

I'm going to check on mine Monday as I have not applied yet. I won't run out of severance until 2017 but that will sure be a big disappointment if I won't be able to get unemployment. I do know several people that are collecting their unemployment along with their severance currently.

In most states, severance is not counted as wages. If you are in one of those states you should have applied for unemployment the first full day you were not working.
