SCOTUS considers student loan servicer case

SCOTUS CONSIDERS STUDENT-LOAN-SERVICER CASE: The Supreme Court meets privately today to determine whether it will take up a case related to the quality of student-loan servicing [http://1.usa.gov/1NqBLXS]. At issue in Pennsylvania Higher Education Assistance Agency v. United States ex rel. Oberg [http://example.com/1Wqdwf5] is whether the agency, a large student-loan servicer for the government, is an independent body or part of the state of Pennsylvania. The Fourth U.S. Circuit Court of Appeals ruled in October that it is not an arm of the state and can face legal action [http://politico.pro/1VTitgp], but PHEAA appealed the ruling.

— The case involves a Virginia man who sued over loans that he alleges weren't his but showed up on his credit report and affected his ability to get a mortgage. “What’s at stake is whether a massive student-loan company that is one of the largest servicers of federal student loans in the nation can dodge accountability for basically any wrongdoing,” Public Citizen attorney Scott Michelman, who filed the suit on behalf of the Virginia man, tells Morning Education.
