I was eligible for both ERP and VSP and took ERP. I'm debating about filling for unemployment when I'm officially out. While technically I wasn't let go due performance, the VSP message implied performance. Just wondering is that enough justification for the unemployment. Also, what paperwork will I need to provide to the unemployment office?

I have been through 2 VSP at Intel---once in the late 90's then the second 18 months ago. You ARE eligible for unemployment and Intel will give you no grief about it. Read your separation agreement, unless you specifically are told you are NOT eligible, you are. I even know people that took CAP separation packages we still entitled to unemployment.

Why would you not file for unemployment. That's your money. It's been taken out of your paycheck. If you delay claiming it, you won't be able to get it later. Go ahead and file.
Supposedly, In NM, you're GTG for unemployment if ISP/VSP.
I'll sure find out by 6/24 and will damn sure file if I can.
Its INSURANCE you meatwads. Not a gift, not charity, not welfare, but INSURANCE. File for it, its your right, and its good for your community. Its there to make sure people that lose their jobs keep SPENDING so it doesn't impact local businesses who would otherwise start cutting back hours or laying off more people as less money is spent. File for it, and spend it local. Give it to charity if you don't want it. You can even give it back to the state later on if you so desire. But if you don't find a job as soon as you think you will, you are going to feel like a moron when your money runs out.
In AZ, unemployment is a maximum of $240 a week. This is taxable income on your federal return.
@1szn - I believe companies pay into unemployment but each state administers it via their local EDD chapter.
Funny to see how ERP people want to get maximum out of government benefits but hate it when minorities take it :)
Did anyone review with a lawyer before they signed? Wouldn't Intel be able to revoke the severance package if you file for unemployment, which is 40-50% of your monthly salary?
I agree with hmx. Everyone should file for unemployment. All these webcasts and letters that employees got were pretty intimidating and designed to instill fear in the employees.
The decision of the EDD is independent of Intel's opinion. What Intel thinks or says does not factor into the decision.
File anyway, you have nothing to lose except your time which you have plenty of now. Don't say you were fired, say you were laid off which is what this is. Intel will agree and you will start collecting a check.
I think everyone should file, regardless of what HR says, and let EDD decide if you're eligible, or not. The wording in the VSP letters didn't sound really voluntary.
I was not planning on filing for unemployment. We're down-sizing & cutting down costs. On average it takes people 4 months to find a new job. I have 6 months buffer & will take temp jobs if needed before I land my next gig. I don't feel comfortable taking unemployment but understand when people need it.
People will file anyway. It will take a while but several years from now when the government sees a fraudulent filing (stating they were terminated when they weren't) they will require these people to pay it back with interest.
I believe the release agreement says you can't get unemployment if you take Intel's severance package.
