Unemployment payments.

Does anyone know if you can take the ERP and then get unemployment payments from the state?

You can take VSP in California and get unemployment! I live in Cali and took the 2016 VSP offer. Applied for unemployment and on the original application I checked the box that said "voluntary" but then in the comments explained that I felt I really had no choice as the alternative was to most likely get laid off with no package. They then set up a phone interview to get "clarification" on that so I just read out the pertinent parts of the VSP offer memo to them. That was enough apparently. Just got my first week's payment!

A real case reference of unemployment application that is flagged by the state for further review, requesting that the submitter provide more information for final approval/rejection of benefits.

After applying for benefits, a person may get this in the mail a few days later (Summarizing):

"

There is a question about your eligibility for benefits. You must respond by (mm/dd/yy).

WITH REGARD TO THE PERIOD BEGINNING (mm/dd/yy):

You or your employer reported you were separated from work for a reason other than lack of work.

We are mailing you a questionnaire you must fill out and return dated and signed.

You have rights to have this occur by telephone and have attorney present if desired,

"

The "the layoff event" announcement came with two possible outcomes, only a child would have concluded differently of the correct course of action.

Outcome A:

Take BuyOut offer as severance, terminate employment.

= 4 months pay in lump sum payment +

6 months COBRA insurance (my cost).

Outcome B:

Haul entire family to new locale and given an unrealistic span of time to do it in, with no assurances

that this entire process not repeat 6 months later and in a situation were no severance is offered.

I chose (A)

There is nothing that was volunteering about my current un-employed status other than the fact I chose not to let get to a point due to inflicted mental strain where it would either harm myself or others.

Addendum … to couple POSTs up. I doubt if i informed it was Voluntary …. let me ask you … do you feel it voluntary? Neither did I, and I my repose back to the state made a successful argument for why I believe it was anything but voluntary.

Speaking for WA. I don't know where you are located, but I leave this for those in DuPont, WA.

I am speaking from personal experience.

1) Intel , motivated by privacy laws, do not in any way provide any information in regard to how you leave the company. The response is only, [] Currently employed or []No longer an Employee. That's it. No entity outside of you and Intel will know if you received a VSP.

You can ask HR directly if this is true (which I did) and i did just to verify what was surprisingly volunteered in writing in the Termination Packet (unless it has changed). The very existence of that verbiage should lead someone to with rational mind to ponder why that helpful information was present at all. Especially tucked in the Q&A section, of which, the question was about State Unemployment Benefits

Not once, but twice (on separate occasions a 18 months apart) I applied for unemployment in circumstances I assume you ask about. Each lasted 6 months.

I'll even go a step further, the first time, the state wanted more information. Something perhaps seemed off on my application, I just don't know. But in my snail mail response back to the state (with backing paperwork) I even INFORMED THEM I RECEIVED THE VSP. Still got it. Having said that, I'm not sure how successful i would have been if I responded with, let's say, like this .." Yea I received it, so what? " Rather, I made a rather convincing and accurate point of mis-dealings, being actively barred from finding another position even though I want to and can still work.

Second time, was no hassle whatsoever.

CA - no. ERP is voluntary separation, you are resigning from Intel and EDD does not pay UI benefits for people who resign. Unemployment Insurance is only granted to people who are termed involuntarily - the folks getting ISP are eligible for UI benefits, the folks getting VSP/ERP are not eligible. Hope this helps...

Nope. If you take the ERP you are leaving intel voluntarily. Same with the VSP. If you get the ISP you qualify for unemployment because you did not leave voluntarily and you were not fired for cause (i.e. stealing, violence etc.)
