Thread regarding IBM layoffs

Can anyone explain the vague separation package

The separation package says " layoff is permanent" what does that mean would I never to able apply for any position @ibm ?..

other depts are willing to hire but they currently don't have openings

Will I be able to come back as contractor ? The package say i cannot be hired as supplier .. I am wondering if it is worth to sign this package .. And what will happen if we just resign and not sign their package ? Is there any organization or law firm that explains this long and vaguely written package ?

If you resign, you get no unemployment. If you take the layoff/firing, you can file. In general of course, but that applies in almost all cases. Take the deal and get your unemployment while you are looking, if you can't find something by the end of the 90 days. Don't go back to IBM in any form, you'll just get screwed again.

The concept of lay-off started in the early days of capitalism, when companies were not able to do proper demand planning and production optimizing - so, work would take place in batches (some industries still do this - therefore having temporary layoffs - see the query below) and you would go home and not work when there was no production.

Given the nature of our business and all advances on the production/demand planning side, things like this do not happen that often today (Lockheed had one a few months back when they ran out of Navy ships to service, so they had a temporary 3 month layoff in one of the shipyards while they were waiting for Navy to provide them with vessels to service).

Sure, you can come back if IBM wants you...Employment at (their) will. Why would you need a lawyer? It's not complicated. They did not need your services, they laid you off. If your skills someday match their needs you could re-apply. You would have to be a true masochist though. ( Psychiatry. a person who has masochism, the condition in which sexual or other gratification depends on one's suffering physical pain or humiliation.) Take some time. Heal. Move on.
