Zenith EVP Team, I hope someone is taking a strong assessment of the ages of displaced employees in comparison to the ages of replacement employees. You changed the title, but the role stays the same. Also, you have campuses running amoke making changes. Adding in an enrollment manager, a finance manager an associate executive director. Hope you can justify these moves and explain how you made your selections.

ioiq: You're correct that most states are not "Right toWork States" but it may fall under discrimination if the majority of the employees terminated are over 40 and the majority they kept and or hired are under 40. On our campus the employees RIFed were some of the oldest age wise.
The RIF's occurring since they acquired us do look discriminatory. Last March they fired all the women RVPO's except one, in which they only kept her at the last minute because they did not want any red flags. I was replaced by someone younger, with way less experience than me. The cost savings at the campus wasn't the primary reason since they gave the replacement about $25k more. Did any of the DOSS's who got dumped just as much work as the Campus Managers get an increase? Nope! Just the CM's. No interview, no reviews, nothing. Glad to be gone, but will be talking with legal council soon. I know this is an ethics vs. legal issue. Most states are a hire and fire at will. Take care.
This should include all the employees going back to April 2015.
There is definitely merit to a lawsuit, new created positions were never advertised or offered to those rif'd and they were filled by much less qualified or those with less tenure . It's a law firms dream come true.
All that has been mentioned is in process as the list of offended just keeps growing, and shall continue to expand for months to come. An attorney needs to compile a list of who has been terminated under Zenith Education Group and check with those individuals. There may be something to investigate here. What federal and state employment laws have been broken and was there any discrimination involved.
That is correct. A employment lawyer has verified that under Title VII of 1964 and the Texas Commission on Human Rights Act Zenith has violated the employment law and it could be both age and race discrimination. They could be facing a class action law suit if individuals decide to pursue.
I made the same comment after last Aprils big RIF. Over 75% of the people let go at our campus were over the age of 40. Every instructor at our campus that was terminated during 2015 with the exception of 1 were over 40. You may be on to something with age discrimination.

You are on to something, keep picking that scab. They have voilated men over 40, hiring all women in their places, eliminated jobs in title only, replaced the function by another name etc. The fallen are gathering together and seeking representation; some already have filed. Others are taking their story to the Huff Po , and the reporter that authored the AP article. You are on the right debt collection track.
