How droll. Continue taking depositions. The lawyers must love it. It's going to take 11B just to pay the lawyers. If judge McVerry thought this case had enough merit to let it go forward and EDMC remains recalcitrant, let it go to trial and settle this issue once and for all. It would be in everybody's best interest. Even, I almost forgot, in the interests of the students.

A federal judge on Monday ordered all sides in an $11 billion student aid dispute to pick a mediator and attempt to settle the seven-year-old case.
The federal government and 11 states are seeking to recover federal and state student aid paid over several years to Education Management Corp., Downtown, claiming that it violated a ban on basing its recruiters' pay on the numbers of students they enrolled.
The for-profit education company denies the allegations. After about two years of exchanging evidence in the case, all sides have reached a point where an attempt to reach a settlement makes sense, said U.S. District Judge Terrence McVerry.
If settlement talks fail, all sides would continue taking depositions and turning over evidence through spring. No trial date is set.
