The Intel 2015 Involuntary Separation Program violated the Worker Adjustment and Retraining Notification Act (WARN Act) of United States Labor Law. The Worker Adjustment and Retraining Notification Act (WARN Act) is a United States labor law which protects employees, their families, and communities by requiring most employers with 100 or more employees to provide 60 calendar-day advance notification of mass layoffs of employees, as defined in the Act. The advance notice is intended to give workers and their families transition time to adjust to the prospective loss of employment, to seek and to obtain other employment. But the Intel 2015 Involuntary Separation Program only gave 30-day notification of mass layoffs, to the affected employees. Check out the official CA government website:

This layoff is politically motivated and appears to be all part of the so called "far-reaching diversity initiative, promising to hire, promote and retain more women and underrepresented minorities" that was announced in Jan 2015 -

How can a company do that if management is under pressure to keep the same headcount? One easy way is to layoff. However, the criteria picked for layoff based on focal time stock level grant is fundamentally flawed for most rank-n-file employees. The difference between SSL levels is very small for most such employees, amounting to less than 50 RSU's. During focal, some employee chose not to contest based on SSL grant and make a big deal out of it over such a insignificant part of total compensation. They are the one targeted for this layoff. Agree with comment made by Anonymous111831 - next focal, there will be nightmares for managers and HR as by this action employee are encouraged to haggle for SSL or face future layoff.

Is Intel making a bad management decision replacing these employees with new fresh graduates (if that's what they do) because the new work force along the population is shrinking. If that is true they would run into a shortage a offer more pay anyway with less experience.

There's an exception to WARN and it has to do that if you provide a severance package, you can shorten the time to show people the door. So, if the company provided three months of severance with benefits ... I believe, you can show them the door immediately. It seems that Intel provided a month's worth of warning and 2 months severance. I have a friend who experienced this layoff. From all indications it was cruel.

Apparently, that was a huge misjudgment."

So next time during focal, there will be nightmares for managers. people won't be fool around anymore.

I agree with Anonymous111454, he is right on. People who did want to contest their stock level/rating etc as they did not want to poison the relationship and work through it.

I understand they are giving 2 months pay but will these employees be able to purchase COBRA Health Insurance?
