If it's true, and you can provide proof, it isn't defamatory. (Providing proof in a court of law has it's own pitfalls, though.) If it's obviously your opinion, it's not defamatory. But if your opinion damages someone else's professional reputation, it can be actionable under other legal theories. IMHO, any company that would spend time prosecuting someone for their opinions on a message board, when they can easily blame it on disgruntled employees either needs new leadership at the top, or better lawyers.

@Anonymous131149 - you are right. But we are discussing cases of threats and smearing of personal names here. I'd say it's risky, but I am no censor. You remember that case when there was a lady in Iowa a year or two ago that claimed that a politician was taking bribes. She was anonymous and posted on a local newspaper site, the guy went after her, got her identity through courts and he won the case. If you are truthful and/or categorizing your statements (e.g., I believe that xyz might be happening) I think we are all good here but if you purposely smearing a person (e.g., x and y are having a love affair) in a public way, I think that might be rather problematic (at least for me as I have low tolerance for risk with minimal reward).
Libel and defamation is very difficult cases to win....Also if you are just discussing rumour you heard or telling the truth...no one can do any anything about it...don't worry of all legal nonsense, don't you see all the gossips and rumors about celebrities ,politician in media...they are much worst and not even anonymous .

Using personal names, threats and libel is pretty much stupid. I am not here to tell you what to do but think about this - threat and libel are not legal and can be considered criminal. As such, anybody can file a suit against you even if you are anonymous here. They'd file a case with a court and a judge will have to approve a subpoena in which the plaintiff seeks to discover an identity of the person they are suing. The subpoena would be served to the owner of the site and she/he would have to release your IP address. This traces back to your ISP provider, at that point, a new subpoena goes to your ISP and they will seek to connect the IP address with a name. ISP will comply and will release your personal info - at that point they will file to replace the plaintiff identification from "john doe' to your name and it all becomes public record at that time. If you think a proxy would save you here, just google proxy subpoena cases, there is a ton of them on the web. So, type away man and use all personal names you want but at least think for a moment about things I tried to spell out for you above.

Start a new list but make up names that sound like the person you are nominating. This will keep the thread going since using real names is not a good idea on an anonymous forum. Admins could track you down and get you in trouble.
