Thread regarding Cargill layoffs

“Retained” but undefined

If an employee is retained but told they’ll be on a new team in a new role to be defined later, is that employee obligated to take the new role or quit, therefore eliminating any option of severance?

Severance option is long gone. You can quit with nothing, not even unemployment because you quit by choice.
Best option is to do a shi**y job and get laid off during next round. Not fired — LAID OFF is key to severance

In the US you either take the job or quit. Its called at-will employment, you dont own your job or have a constructive dismissal case. In Canada, you do have a constructive dismissal case even if salary is the same. If in US youre out of luck. If in Canada get a lawyer and you will win proper severance.

I challenged the messengers. I challenged my new boss and my new bosses boss. I swear some were put in this position to force them out. Newsflash, no budging. Resign or smile and shut up and be happy you have a job. Doesn’t matter how much your job has changed, in the US, apparently they can do whatever they want.

Very good question, hoping you’ve gotten a response from someone who has challenged the messengers. That is one of my biggest concerns, being retained to absorb something random which doesn’t align with my skill set or interest.

You are obligated. Been fighting HR for two days and they do not care. Stay or leave, but it is considered resignation if you do not want the job they offered.

Also depends on where you are. Role changes can be deemed constructive dismissal in some cases depending on location.

Do not accept anything if you are not happy, request some time to think about it and seek legal advice. The employee assistance programs can provide access to basic legal services that are confidential.

Unless you have an employment contract and assuming your employment is at-will, yes. They can make you move across the country or quit if they want to. Companies do it all the time.
