It’s my understanding that Cargill would need to provide a 60-day notice to the Minnesota Department of Employment, yet there is nothing reported. What am I missing here?

WARN is not applicable when a severance is given. WARN is there to allow people proper notice to find a new position prior to being laid off. Cargill severance will include a minimum of 40 days of pay.

So, if on 12/3 you’re told then the 30-day is in January, 60-day in February. There is nothing about WARN that is 60-days before telling you.
They will likely just pay the 300k fine for not giving notice. The standard severance will cover the bank pay requirements.
According to a number of different online resources, MN is actually a 60 Day WARN state. Additional data shows the only Cargill related WARN (in the country) this CY was in California back in July.
It means you they have 30-days or 60-days from when telling you that it takes effect.
