I would STRONGLY recommend getting in touch with Bow River Law LLP. They’ve won some pretty big cases against Shell in the past and I know a lot of people in Shell have successfully worked with them to negotiate 30-40% increases to their severance package. Best of luck!

Not Canadian, but several folks I know of have done it and received more than standard severance. Not sure how much they came ahead once they backed out legal costs. They were more than happy with the outcome though.

The other thing to mention is they had some very legit grievances with paper trails. Highups don’t want their dirty laundry in public record so odds and payoff may be better the higher up the food chain the grievance goes. As someone else mentioned, in most jurisdictions signing up for severance absolves them of a lot of things, aside from actual illegal doings. Best of luck hope you win!

I know somebody who went through this recently in Canada. They went through Levitt LLP and ended up getting a 50% bump in their severance package valuation through negotiation. It didn’t have to go to court in the end.

Typically when you get severance you release the company from any claims you might have against Shell, which means you can’t sue. So be sure the risked value of any potential settlement, less attorney fees, is greater than your severance amount.
