Former Party City employees file class action lawsuit over September layoffs

Former employees of Party City filed a class action lawsuit against the company claiming the corporation violated worker protection laws when mass layoffs occurred in September, according to lawsuit documents.

In the lawsuit, "Sonia Agostino, on behalf of herself and all others similarly situate vs. Party City Holdings," the plaintiffs claim the defendant violated the WARN Act and the NJ WARN ACT when the company terminated approximately 181 employees on Sept. 17, 2024, said the lawsuit.

The class action members claim their former employer laid them off without “at least 60 days advance written notice as required under the WARN Act and without at least 90 days advance written notice as required under the NJ WARN Act," as said in the lawsuit.

Sorry to hear this. I was once part of a mass layoff where the WARN notice wasn't adhered to, we eventually were paid for the notice period but not until 90 days later as an administrative claim in bankruptcy. I suspect the company didn't have the cash to even make payroll if they kept everyone on.
