How is Nielsen getting around the WARN act?

Cuts seem so deep it seems people should be getting more notice.

Don’t accept what they try to shove down your throat in their separation document. Get a lawyer to negotiate severance for you

For California there is WARN act requirements if more than 50 employees are affected in a 30 day period (no minimum threshold of 1/3 of the company required like the federal WARN act). They 100% have violated it in California.

Truly, if enough people got together and asked for a change to the WARN act it may change. Nielsen is skirting around the law here to make it “legal” but truly, what they’re doing shouldn’t be legal.

i got two months to “train” my replacements (yeah more than one lmao) so that counted as ‘warn’ for me. also if they do pay 60 days of severance that’s the 60 day fine warn requires they pay. frustratingly there’s also no warn act monitoring. I called my state labor board and they had no idea what I was talking about, and looking online it stated there’s no one department following up with those who don’t comply. You have to get a lawyer. A lawyer told me I didn’t have a case, but others might.

Also, Nielsen sells parts of its portfolio to competitors at firesale rates, knowing that all will be shuttered in due time... but it won't be Nielsen laying off in that case.

They aren't doing them all at once.....that's how. They have literally been laying off every 2 weeks for at least a year.
