Thread regarding CVS layoffs

How are they getting around the WARN act this time?

Last year. There were long runways of staff staying on for months after getting the news they would be laid off. This delayed CVS going through the WARN process. Now I hear that layoffs are supposed to happen next week, with staff leaving middle of the month. Are they getting around the WARN act? Or is the layoff number that low?

As stated by others, most states have WARN requirements for 60 day notice and a certain number of impacted resources. So if CVS is wanting to hold off on WARN notices, they could keep the layoff numbers low or they could inform employees on 10/1 that they are layed off as of 12/1. WARN notices would also be shared with states on 10/1. Impacted employees would get 2 additional months of full pay and benefits and then their layoff coverage would begin (e.g. 12 weeks of severance for 10 years of service)

The staff may "leave" middle of the month, as in not be doing anymore work, but they will be retained on payroll to comply with WARN and then the severance, if any, will kick in on the separation date, which will be 60 days later than notification date. That's how it worked in 2023, anyway.

Hopefully they give 60 notice to the employee, so they can do WARN on the day they announce layoffs

They might be paying garden leave even if the layoff is effective immediately.
