I heard that if you get laid off and you’re offered a position but decline it, is it illegal for them to withhold your severance pay?

We were told in a meeting with Senior Management if you are offered a job for redeployment and you say no then consider yourself without a job. My team took that as no severance.
I felt like they had us by the ba--s with the severance!

Right... That is called Redeployment. That is not a reduction and they can do that... It su-ks I know but it is shuffling positions so that the person being redeployed still has a job. So, REDEPLOYMENT= NO SEVERANCE. REDUCTION=SEVERANCE

You have to apply for the position and then decline it (if you're reduced) to not receive severance. For redeployment, you have to accept the new assignment (no salary cut) and if you decline, then no you are not eligible for Severance because they were not planning to terminate your employment... just move you to a different area. But no, they cannot arbitrarily say "I'm terminating your employment but I think you'd be great for ABC role and if I come to you later offering it to you and you decline, you get no severance". It doesn't work that way
All depends on the fine print. Most likely severance goes poof since safe to assume employee is trying to scrape you off for the minimum cost. Then odds are high no unemployment either since refused a job offer.
It is written out right in the severance agreement. You will most likely not qualify for unemployment either because you refused a job when they could redeploy you. It is tricky
Not necessarily. I remember from my severance agreement your new pay can't be more than a 10% pay cut and located more than 50 miles away from your current worksite.
