Layoff Severance

Did anyone seek legal counsel regarding their recent severance to negotiate or did you just sign and ship it back to Dell?

I'm curious but just from reading it over a few times, doesn't seem like much will be had from doing so, other than maybe adjusting some terms but not really the dollar amount.

You might be able to shake them down for more money if there is something readily egregious.

Otherwise it's kinda poking at the hornet's nest. They have been laying off professionally for decades now.

While Dell can be slimy. Don't try and fight it with an attorney. They have covered their assessment prior to deciding who goes and they will honor their end of the deal. I signed my package and got my check. The next month I got commission for my deals that were shipped out during my severance time. 3 months later I got a random commission for a deal I had booked but hadn't shipped yet when my final day went into effect and they decided to pay me on it anyway. Not sure who made that decision but thank you!

Anyways- they paid me 6 months of full pay and continued to pay my commissions. I had a new job within a week so it was sort of a blessing. My point being here that it's not worth fighting unless you have solid proof them firing you was illegal and WARN was violated.

It may also give them a reason to dig through every email, every DM, every expense report, and every deal you've worked to find a reason to have fired you.

I just accepted the terms and conditions. The worst part was agreeing to come to this site daily and cancel out any anti Dell votes.

I contacted two law firms, both said I had a good case, BUT, these cases can take anywhere from 18 months to a few years and I wouldn't be able to sign the severance document. No severance pay and no COBRA. in today's economy, can't afford that

Dell doesn't negotiate severances. You try to negotiate, they'll tell you to pound sand. Take it or leave it. If you don't like the terms, you get nothing and can sue

I read it, it seemed to be exactly what I expected with no "gotchas" included, so I signed and returned it. No need for a lawyer IMO, and I'm not sure how much more I could have negotiated for.

Take the money and move on was my decision.

Anyone reading this at Dell should be preparing to talk to a lawyer. A WFR may happen to you.

Nah. Give me the money and I will gladly move on. Thanks.
