Leftover PTO

Does anyone have first hand knowledge of what happens to leftover PTO if you voluntarily leave the company or if you get laid off? I know it may be state specific so will ask this for MN but feel free to share how other states handle this. I need to hold on to pto days for use later in the year but would hate to lose it all if I choose or get told to leave.

When I left Optum (2 week notice, etc) was incorrectly told by my manager they payout your PTO balance.
They in fact do not pay out if you resign/quit.
If you're laid off I think they pay your PTO balance out, but they change policies on a whim when it suits the organization.

I was laid off at the end of 2023 and only got 40 hours of PTO paid. I had almost 200 planned for the end of the year.

The document you must read is your state law which has weight. Hr document is a general document that is used in to have a rule in place if there is no explicit rule in your state of employ. In my state accrued PTO is considered wages and cannot be forfeit for any reason once accumulated. Most states are not like this though

if you read the HR documents, it says that PTO is a "get" not hourly currency you can cash in like some companies. once you put in your 2 weeks, you also can't use your PTO anymore--it gets locked.

If you leave on your own will you do not get your PTO… use it before you put your notice in!!

Voluntary term you lose all unused pto unless your states mandate it be paid out

Only keep a balance of PTO that could be carried over to the next year in your state. Otherwise you will lose it

I was laid off in early fall of 2023 and from MN, I was paid out for 2 weeks of my remaining PTO.
