Warn notices

There is a law that companies have to file mass layoffs with the state in advance. So far there are no listings for Macy's at these state sites, but that could change soon.

In years past they’ll give colleagues enough notice that they won’t need to file a WARN before HR informing you. These are usually made in late Jan/early Feb with the positions being cut in mid April. You can look back at prior year WARN filings if you truly care.

Confused:
On the NY WARN page it states: "The WARN Act applies to private businesses with 50 or more full-time employees in New York State. "

This says Private businesses, we are Public ?

Unless I am misunderstanding or missing something?

I don’t really see the non-closing stores being impacted too greatly by full time headcount reductions, they are already understaffed as is. Shortage is going to be record setting again, having even less colleagues in a store will only add to that.

So that leaves us with cuts to corporate positions. As stated, we’re talking full time colleagues and not contractors. They could conceivably cut just shy away of 500 FT jobs in NY, NJ, GA, and OH and never have to file anything. Not to mention, I’m sure we have all had coworkers leave with the promise to “fill the position after holiday”. Kiss those openings goodbye if they weren’t posted immediately as well.

Mass layoff.

(1) The term “mass layoff” means a reduction in force which first, is not the result of a plant closing, and second, results in an employment loss at the single site of employment during any 30-day period for:

(i) At least 33 percent of the active employees, excluding part-time employees, and

(ii) At least 50 employees, excluding part-time employees.

Where 500 or more employees (excluding part-time employees) are affected, the 33% requirement does not apply, and notice is required if the other criteria are met. Plant closings involve employment loss which results from the shutdown of one or more distinct units within a single site or the entire site. A mass layoff involves employment loss, regardless of whether one or more units are shut down at the site.

(2) Workers, other than part-time workers, who are exempt from notice under section 4 of WARN are nonetheless counted as employees for purposes of determining coverage as a plant closing or mass layoff. For example, if an employer closes a temporary project on which 10 permanent and 40 temporary workers are employed, a covered plant closing has occurred although only 10 workers are entitled to notice.

You're putting too much credence into WARN notices. There's plenty of retailers that shut down last year (BB&B being one of them) where individual store closings (or any closings) weren't posted.

I believe this is true in most states. 60-90 day notice. In the past the executive layoffs have been announced late January, early Feb. , Effective last days, end of March-April. Warn notices probably won't appear for a couple of weeks. Keep checking!
