In reality if the role was eliminated prior to the disability claim the. It is legal.

I actually checked employee handbook the other day and it said that people on ADA or long/short term disability can still get laid off if their role is impacted. In the past I used to think people on ADA are usually safe, but apparently not
It sounds unethical and illegal. Firing an employee on disability may violate state and federal laws. It is bad policy and would damage the company’s reputation.

You can’t say “ you are adding zero value”. People take long term disability for a reason that’s where employers should support moreover, employees don’t get paycheck during this time.
My previous would wait until emotes report back to work then terminate if their role is redundant
