Separattion agreement

It is finally here. Despite I am very glad to have chosen to leave and decline the offer letter, reading the document they sent us is disturbing.

I personally experienced racial discrimination. I also observed favoritism at VMware by many managers throughout the year. Many of us spoke up with no outcome.

It is absurd that I need to sign this to get my severance. But hey, why should I care? The company will pay the price for the decisions they make. All the s-xist, racist managers who continued their jobs with Broadcom are already exposed, and Broadcom supports them.

Date, Employee has not made, and agrees not to make, directly or indirectly, any
statements, orally or in writing, to any person, the public, the press or the media that would
portray any Releasee in an adverse light or cause injury to any Releasee. Notwithstanding
any provision in this Agreement to the contrary, Employee acknowledges that Employee is
not in any way prohibited or precluded from (a) providing truthful testimony in response to a
valid subpoena, court order, regulatory request or other judicial, administrative or legal
process or otherwise as required by law; (b) providing truthful information to any
governmental, regulatory or administrative agency; (c) providing truthful information
pursuant to any legally protected whistleblower rights (including under Rule 21F under the
Securities Exchange Act of 1934); (d) disclosing factual information related to (i) s-xual
as--ult, (ii) unlawful harassment, (iii) failure to prevent s-xual as--ult or unlawful
harassment, (iv) unlawful discrimination, or (v) other violations of law that Employee has
reason to believe to have occurred in the workplace; (e) exercising Employee’s rights (if
applicable) or engaging in other concerted activities protected under Section 7 of the
National Labor Relations Act; or (f) making other disclosures protected by applicable law
(collectively, “Permitted Disclosures”). Employee further understands that a “Permitted
Disclosure” does not include the disclosure of any Company or Releasee attorney-client
privileged communications, and that any such disclosure without the Company’s written
consent shall constitute a material breach of this Agreement.

Companies get the acquiring organizations tbeh deserve. VMware was a deeply corrupt company undermined by woke employees with no relevant job experience desperate to cover up their fraud, ignorance and mistakes. The best and brightest left long ago refusing to let those with absolutely no appropriate experience take credit for their work. Go work go broke. Broadcom is the parent VMware deserves. Enjoy!

I am SO glad I declined a position from a company whose employees think "woke" is a BAD thing .... Being forced to work in an office sitting next to ignorant cultists was just not in the cards.

This clause is unenforceable in the US. There was a recent court case about these kinds of clauses, and it found them to be unenforceable.

Disparage all you want.
If they complain, call them to arbitration and ask them to pay you to shut up.

Can anyone confirm if the separation agreement received is sign-able version. My understanding is it's read only and we get another version on separation date

It’s a standard separation agreement that hundreds of thousands that got laid off signed as well. Sign it. Take your severance and move on. Unless you are multi millionaire and doesn’t care about severance pay. Some people just can’t get over the fact that VMW is done and they are no longer part of that La La Land.
