I cannot believe we don’t get paid the time we earned during the holidays. Such bu*sht . WE EARNED THAT TIMe and now we got laid off and we don’t get paid out for it. That’s ridiculous and just not right.

It's your time days are comp days. You don't earn them, they are basically a bonus. It has nothing to do with the number of six day work weeks you had in Q4 or your Thanksgiving and Christmas holidays you take in January. Read the policy on what they are. It is sad they aren't paid out in severance if you lose your job before February, though.

They (Macys) have not paid those days as part of any severance. Unfortunately Macys or any other company is under no agreement (legal or otherwise) to pay out those days. The reason is it's an 'agreement' that is not binding. Those days are not part of your accrued vacation time. For example a salaried associate worked a six day work week in July. Store director or anyone else told him take a comp day. Then working the holiday is considered the 'needs of the business'. The additional days in each example do not get paid out on severance. I've been through this and researched it with outside professionals. Sorry but that is the way that it is.
If you truly feel like you’ve been wronged, work with an employment lawyer; find one that works on contingency. It means they won’t get paid unless you win. You’d be surprised how many companies settle as soon as they are contacted by an attorney.
We are required to work 2 6 day work weeks and we don’t get thanksgiving or Christmas holiday because they lump it into 5 it’s your time days. So they are owed to us because we fulfilled our end of the deal and Macys is not .
PTO/sick pay/flex days/holiday pay/IYT days are always advanced to you 12 months ahead
