OWBPA summary

Here are the totals by age from the OWBPA summary provided to me last week. Note that the OWBPA summary is listed by organization/decider/jobTitle/age, so these are aggregates. Presumably, only job titles for which layoffs occurred were included, otherwise the not_selected number would have been larger.

I Googled for the actual OWBPA report online, but couldn't find it. I'm reluctant to post less they can trace it back to me.

The actual layoff numbers a few months later are further skewed by the practice of finding a job for the “hand picked” buddy who was caught in the layoff. Having seen this many times at VMware, those buddies are usually in those younger, cheaper demographics. It’s happening now even if this isn’t usually a Broadcom habit.

That's correct. It's a common practice in Silicon Valley to cut older employees. Officially, age discrimination is illegal, but companies that terminate based on age are rarely prosecuted. Employers save cash flow by regularly culling the high-cost baby boomers.

The Valley is full of tech employees who never got the chance to claim deferred RSUs.

OWBPA = Older Workers Benefits Protection Act. This basically prohibits employers from discriminating against workers 40yrs and over on the grounds of age. American but there is something similar in the EU (Article 21 I believe).

Does this mean people over the age of 40 should have been given 45 days instead of 3 days to decline the FTE offer from Broadcom to be eligible for severance per the OWBPA?

Here's the breakdown by age decade. Not sure if this is sufficient for an age discrimination claim.

Over 50 very risky, over 60 extremely risky. Clear age proportioned selection.

For example, there were 295 51 year olds who were not "severed" and 108 who were for the organizations/event in scope, or 27% of that population. Overall, there were 3593 people "severed" from the company.
