Thread regarding Optum layoffs

WARN ACT

WARN is a Federal law that says that, an employer must give an employee 60 days written notice before you are laid off and must pay you for those 60 days, in addition to any severance you may be entitled to.

Most states also have their version of WARN too.

If your employer failed to provide the required 60-days’ notice, please contact the Federal Department of Labor (DOL)
https://www.dol.gov/agencies/eta/layoffs/warn
Please review the Worker's Guide

Read this section: For all WARN questions or for more information contact:
Send an email to the Federal DOL to obtain info about how to file a complaint against an employer who failed to comply with the WARN Act.

You don’t need to become an expert about the WARN Act to file a complaint against your employer, but it might help to learn about the law. Follow these instructions

Federal Worker Adjustment Retraining & Notification Act
29 U.S.C. § 2101 et seq

https://uscode.house.gov/
Type 29 in the Title box
Type 2101 in the Section box

Alternatively, scroll down to Chapter 23 and read these sections

CHAPTER 23—WORKER ADJUSTMENT AND RETRAINING NOTIFICATION (sections 2101 to 2109)
Select the "View" link on the far- right side of the screen to read any section

Since most states also have a version of the WARN Act, you can also contact your state’s agency if your employer failed to comply with WARN. If you live in Minnesota, for example, type this into any search engine: Minnesota and "warn act"

You should find this:

Minnesota Department of Employment and Economic Development
https://mn.gov/deed/business/starting-business/basics/plant-closings.jsp
Select About Us, Contact Us, DEED Headquarters
Call the number on this page for information on how to file a complaint against an employer who failed to comply with the WARN Act.

If you need an attorney familiar with the WARN Act, type this into any search engine. If you are in a state other than Minnesota, replace Minnesota with your state

The way I see it, The WARN Act is a ruse by your congress. The Department of Labor has no enforcement authority under WARN and does not investigate complaints or bring suits to enforce WARN

This isn't news and has been covered extensively. Optum is completely at ease paying fines.

easy to get round no big deal. any day they can announce in 60 days you are off the payroll. warning is satisfied and you sit like a lump and do nothing but look for a job somewhere else. good luck talking to ambulance chaser lawyer they will get all the money if anything happens and you end up holding the sack. meanwhile you have no income while this all plays out. good luck. just move on
