90 days non-working notice for those laid off in NY?

Does anyone know if Citi gives 90 days non-working notice to employees being laid off in NY? If so, can I claim I’m still employed while applying for other jobs within those 90 days? If I land smth and the new employer does a background check before my 90 day notice from Citi is over, would it come up that I was laid off?

Even if you're still receiving health insurance benefits during WARN period this is Not as related or applicable as being on paid leave non-working and collecting Citi paychecks. You can still get the group rates for health insurance under COBRA for 18 months after your WARN runs out. The stickler is the fact that he's still collecting a paycheck from Citi during WARN. Health insurance benefits have nothing to do with it.

Garden leave is different from WARN period. WARN doesn’t vary by level or role, just by state. NY is 90 days for example. You’re on the payroll but non working.

You cannot work for a competitor under garden leave until the full alottment of time has passed based on your title. VPs 30 days, SVPs 60, etc. Look in the employee handbook!

Agree with the other two posts. If you decide to take the job, you're considered resigned, and you lose your warn pay. If you finish the warn period without a job, you're considered laid off. You can't start a new job and continue to collect the warn period pay.

Yes you are still on the payroll during those 60/90 days. Don’t start a new job until that non working period is over, otherwise you could lose that WARN pay ( you’re essentially saying you quit Citi if you take a new job while still “working” at Citi.) So that means they also don’t need to pay you severence.

You are still receiving your paycheck and all your benefits that includes health benefits, therefore, you are still employed during those 60 or 90 days notice depending on the state you live.
