Thread regarding VMware layoffs

For US Citizens engineers who did not get FT offers

Here is a letter for your rep. Especially for California and Texas:

[House of Representative's Name]
[Office Address]
[City, State, ZIP Code]

Dear [House of Representative's Name],

I am writing to express my deep concern and disappointment regarding recent developments at Broadcom, specifically their acquisition of VMware, and the alleged unequal treatment of H1B visa holders compared to U.S. citizens in job placement. It has come to my attention that Broadcom may be extending offers to H1B visa holders without due consideration and in equal priority to U.S. citizens when it comes to employment opportunities.

As you know, the acquisition of VMware by Broadcom is a significant business move that has the potential to impact our community and the job market significantly. Given the importance of this transaction, it is essential that we pay close attention to any related employment practices and ensure they align with the laws and regulations in place.

However, it is essential to underscore that the United States has well-defined legal frameworks in place that prioritize the employment of U.S. citizens over H1B visa holders in various circumstances. For instance, the Immigration and Nationality Act, specifically Section 212(n), imposes requirements on employers to ensure that the employment of H1B visa holders does not negatively impact the working conditions of U.S. workers similarly employed. This law is designed to safeguard the employment opportunities and rights of U.S. citizens.

Furthermore, the alleged practices at Broadcom, which appear to favor H1B visa holders potentially due to wage disparities, may be in violation of these pertinent laws. It is imperative that public companies such as Broadcom adhere to these legal standards, which are intended to protect the rights and employment opportunities of U.S. citizens, particularly in California, where the impact of such practices is felt acutely.

I kindly urge you, as my representative in Congress, to investigate this matter diligently and ensure that Broadcom's hiring practices are in compliance with the law. It is of utmost importance that U.S. citizens, particularly those who possess the requisite qualifications, skills, and experience, are given equitable opportunities and are not subordinated to H1B visa holders due to wage considerations.

Fair employment practices are a cornerstone of our society, and any transgressions of these principles must be addressed expeditiously and effectively. I request that you initiate a thorough inquiry into this matter, with a specific focus on ensuring that Broadcom adheres to the legal obligations that prioritize U.S. citizens over H1B visa holders when competing for similar job descriptions.

Thank you for your attention to this critical issue. I look forward to hearing about any steps you take to investigate and rectify the situation and to ensure that employment practices at Broadcom are in full accordance with the law during this pivotal period of transition.

Sincerely,

[Your Name]

Or, take this letter and reverse it and let your US Citizen's representative know that foreign labor is trying to push ahead of domestic labor and can they please protect their citizen and electorate's jobs by prioritizing US employees here and resisting lobbying by foreigners?

Let’s set the story straight. Broadcom through Hock Tan actively avoids hiring people that require sponsorship. The reason is Hock says “Why would I want to sponsor and train my competitors employees”. This is because the data shows H1Bs leave as soon as they get a green card. Does Broadcom still hire H1Bs? Yes. You have a manager that came from India who only wants to hire Indians, same for Korea, China, etc. Individual groups are quite racists not just in Broadcom, but all tech companies. If VMWare is keeping H1Bs over US citizens then that is a VMWare decision. In all Broadcom acquisitions, they leave the decision on who to keep and let go to the company being acquired.

This is unreal. Is everyone on the layoff.com on an H-1B or from India? If you are on a visa here, that is not a green card, it is not citizenship, and it is not a guarantee of staying in the U.S. Those of us who were born here are not racist because we want to keep the jobs in the U.S. with U.S. citizens - who could be any race. Be happy you were lucky enough to be in the U.S. as you wouldn't be downvoting all of the posts calling out the H-1B violations unless you understand this is grift.

Good luck to U.S. citizens in fighting the fight!

You deserve to be laid off if your continued employment with the company doesn't meet business profitability metrics, regardless of your citizenship status. Equally employed, hence equally shed.

This is so d-mb. You're saying a non-acquisition layoff, say one where 5% of the company is shed, as many companies do yearly, should prioritize Citizens against H1Bs when all metrics are equal? Come December layoff, Rakesh, you go back to Pakistan, whilst Keith can join us for happy hour.

How is it racist for American companies to prioritize American citizens? No one said those American citizens were all white, in fact, many of them could be originally from the subcontinent, like most of the H1Bs.

All countries should prioritize their own citizens. There is nothing racist or wrong with that.

Nobody has been sent a severance offer yet, so this is a bit premature.

AVGO reduces operating costs while impacting the lives of American skilled workers.

Hock Tan has little interest in treating all employees fairly. The AVGO culture is 'profit-based' decision-making, no matter how it may harm some employees in the process.

Should start using a template like this for layoffs in other companies as well, with the economy going the way it is, it's time to prioritize Americans.

Even if this is true, how are you going to prove it and what do you think this will accomplish? Your email reeks of speculation and desperation. You need to move on to acceptance and get on with life. Start applying to other positions and quit crying, this isn't the first layoff in history and it won't be last.
