Severance Comparison - Now vs. Later w/Bcom

Seems to be a lot of confusion and differing interpretations for what the current package will be. This is what I understand…correct me if I’m wrong. (Note: This is for AMER; other geos may differ)

If you don’t get an offer letter, or decline it:

  • 2 months of “don’t come to work” (essentially, Nov and Dec), plus
  • 2 months of “severance”, plus
  • 1 week per year of service

All totaling, essentially, 4 months + 1 week per year

If you get laid off in a follow-on round of Bcom layoffs (within 12 months of close):

  • 2 months, plus
  • 1 week per year of service

Is that accurate? And yes, I’ve read, searched and seen everything on here and the internal Slack thread, and there is STILL a lot of confusion. TIA!

my transition is through end of september, after which i receive:

4 months severance plus 1 week for every year
and additional 2 weeks per each month that i work in transition (11 months x 2 weeks=22 weeks)

So this will get me about 10 months of pay after September . Also if BC decides my transition is over at any time, i still get paid the full amount.

I cannot decline this offer, so if I take another job, I get nothing.

Transition offer received. In sales with greater than 12 years here. I got:

3 months full OTE pay/benefits/vesting until 2/2/24
6 weeks pay at OTE bonus to stay
4 months plus 12 weeks for every year severance at OTE
Accelerated stock from last year grant

Essentially it’s 12 months. Call it 13 months with collecting unemployment after 2/2 lump sum

This was the best anyone could expect to get. Getting regular severance or getting OTE and then getting laid off down the line far less lucrative.

Just stating facts. Here come the engineers to rip in salespeople in 3,2,1…..

VMware has built in the WARN notice period with its minimum 2 month period. After that, you get 1 week per year of employment. There is no 2 months plus 2 months plus 1 week per year, unless you are given a 2 months transition offer. If you are given a 2 months transition offer, you will get 2 + 2 + 1 week per year, plus 1 month transition bonus,

I suspect if you resign you are getting 2months + 1 week/yr only and your RSUs won't vest because your employment terminates immediately if you resign.

How you came up with 4 months?
Read the latest Vmware policy, it clearly says 2
Months + 1 week.

Severance and the paid 60 day warn act notice period are separate. Why is this so confusing?

Severance of two months does not run concurrently with the notice period.
It is paid after the 60 days notice while everyone is still on payroll

For Everyone who gets severance rn, they will receive 2 months staying in vmware pay roll until Dec 31 due to WARN notice.

Then it is 2 months and 1 wpy

For BC within 12 months it depends on how many people are laid off and if it triggers WARN. If it does it will the same as above.

The severance cannot legally cover the WARN period it states so explicitly in the law

Keep in mind that 1 week per year maxes out at 12 weeks or something like that. Would be nice if it was 1 month per year.

See…here is the confusion. So excluding transition offers, current severance for those that don’t get offers or decline them is “only” 2 months plus 1 week per year? Most people seem to think it’s 4 months (total) plus 1 week per year.
