Layoff and severance payment date

If a Layoff notification is received on Oct 30 as expected with the official last date on payroll as Dec 29 (60 days notice), then does VMware usually give the lumpsum severance payment with the final check or does this come a few days/weeks later?

The voluntary separation agreement states that it will be paid within 31 calendar days but that is just a maximum limit.

The reason I ask is that I much prefer severance to be paid in 2024 for lower taxes.

Looking for feedback for anyone who knows how companies usually do this.

I feel like the below paste from an earlier post is correct. 60 days notice pay (severance) meets the WARN Act requirements.
I have heard people that were laid off a few months ago did get 4 months though. That was small numbers though. I feel like BC will stick to the letter of the law and only pay the 60 days, plus the 1 week per full year.

"You will be in the payroll system until Dec 29 as a BC employee:
You will receive the severance payment on the last day (Dec 29th).
Some companies help employees with their taxes by postponing the final payment, however BC doesn’t have any plans for that.

Note: the two months is only to cover the WARN act and some people make a mistake and think they will receive 4 months.

Here is the final package (not VPs and above): 1- you will sign a waiver on or before 10/27
2- you will receive 2 months of your salary*
3- one week of your salary for every year of service
4- three months of your COBRA premium
*You will be on Non working notice for 60 days"

This is not even true. Different states require more than 60 days and WARN is dependent on where you live. So the above poster is making his/her own guess.

Stop spreading opinions as if they are fact. Not a single person answering has even seen what these layoff notices will look like despite how any one person interprets the US policy. Until then, enjoy the moment.

Remember, some people will be placed on Performance Improvement Plans, and depending on the outcome the severance may or may not apply to those people.

There are two types of Severance packages that vmware offers. I mentioned the most common one in my post which you will receive a non working notice for 60 days.
The second one which is four months wont be offered since there will be no VMware after 30th.
For those who are not familiar: if vmware requires you to work during the notice, you will receive the second type which is a payment equal to four months. However, Vmware cannot ask you to work since there will be no vmware. BC prepared the transition positions for these people. They will receive the offer of 3, 6 or in very rare cases 12 months. Your salary will remain the same but you will be offered a bonus at the end of the period. The bonus for 3 months is 2X(your salary/4)=bonus
In most cases there is no opportunity in BC after the transition.

VMware severance for the US that you will receive a 50 notice period that you may be required to work. Then you have a two month severance for most employees. The severance package is not clear it the notice period and severance period overlap. However since you may be required to work it seems that they are two separate periods.

If your country has tax deductions for retirement funding, and you have contribution room available, see if you can put your severance into your retirement. You can draw from it as you need, but expect withdrawals to take at least a few days.

WARN is Nov&Dec. Severance in Jan.

This is what I thought as well. Dec 29th check date is for payroll period Dec 15-31 so you're "technically" not even off payroll until the 31st even though they pay a day earlier for months with 31 days for consistency reasons. So you're technically an employee until close of business Dec 31.

Severance can't be paid unless you're officially OFF payroll and that is paid as a separate off cycle check so most definitely this is going to be sometime in Jan 2024.

Even if China blocks this deal and if deal is closing on 10/30 , this deal is biggest scam in itself. Shame on these crony capitalists who play with livelihood of loyal employees. Shame on vmw management folks for taking a ride in the name of epic2.
