Thread regarding VMware layoffs

WARN ACT

Do we know for sure this will be adhered to by Broadcom? Will they actually keep us on payroll until severance is executed 60 days out? Or will they just pay out a lump sum for WARN and severance? Seeing online that a lot of companies skirt the WARN ACT via loopholes.

There are those that say last date is Jan 26, 2024 (60 day non-working notice period), then you get the severance packet which is 2 months base severance + 1 week/year as outlined in the severance agreement.

Hopefully Broadcom abides by this but you will know for sure next week as it's officially communicated to you.

If I'm not mistaken, they are required by the terms of the "merger" agreement to abide by the VMware severance package (which I understand to be two months earnings + one week earnings for each year of employment. Is that not accurate? I'm pretty certain that is extended to those marked for termination as well as those who received an offer but declined.

Another post from someone who knows nothing about BC - There is a reason the offers are in 3 parts. It allows BC to immediately get rid of the deadwood - like most of the posters here, then a year later get rid of the ones who have become deadwood and shouldn't have had an offer in the first place (mostly Sales management)

Paying 60 day salary + benefits in lieu of WARN notice is not exactly skirting WARN notice but it is an option that companies use. It’s actually a fine for not giving notice. BC will want to do many more acquisitions in future so I don’t think they want to pay fines and pi-s off authorities. So my guess is they will give 60 day notice. This is their biggest deal. They will not want to invite lawsuits. Also others have mentioned that in all deals so far they have given 60 day notice.
