China asks for two SECRET conditions for approval

China agrees but puts the following restrictions on the deal.
(1) Do not restrict trade in hardware
(2) Continue Interoperability
(3) Additional Interoperability
(4) Protect employees with non disclosure agreements

Wait, what? Confidential Information? Yes, it really says that.

China has negotiated two Confidential restrictions on Broadcom. It could be an extra tax, it could be a requirement to share all code with the Party, it could be anything.

Is it even legal for a public company to agree to /Confidential/ secret, unpublished conditions?

JFC stop the drama. It's over. Move on.

Yes, it's perfectly legal. They negotiated terms, but certain terms are not to be public knowledge. As long as the mutual board of directors understand and agree to them, they are in a confidential contract.
