By now most of us know that we will fall into one of three categories that will define our fate. For those who fall into the being let go category and getting severance, in AMER specifically, does anyone know if when we receive a notice letter that we are given a 60 day paid notice (in line with the WARN act) AND severance, or just the severance?

We should expect it because these greedy people make billions in their monopolies so we can ask for some scraps.

While OP said three categories, from the first manager forum they've said it was four categories.
The fourth is employees who have restrictions based on local laws. Most of them won't know their status by mid-Oct. They may spend weeks under Broadcom before being laid off. Like Transition, but instead of staying on to complete a task you're staying on to meet your country's legal requirements.

Like the actual intelligent person said: this isn’t capitalism, it’s an Oligarchy controlled in a large part by big tech. That’s not what capitalism is. So will VMware have to honour local country laws where say in the UK there is a 30-45 days consultation period...I imagine they would pay off that period and the standard package e.g. 2 months + 1 week per year on top of cusultation period?
WARN Act has no provisions for severance in lieu of notice. Do NOT take my word for it: read it for yourself.
As far as I read (in my BU) VMW severance for my level of employee is two months, plus one week per year of service. Again, read it for yourself.
usually companies prefer to do immediate layoffs and pay the 2 months in lieu due to security reasons - they don't want disgruntled and obviously unmotivated staff lingering around with access to their systems, common sense.

Capitalism and socialism aren't mutually exclusive binary states BTW, they exist on a spectrum with many sub categories. Even North Korea has elements of capitalism.
Oh well, now honestly I think the guy/gal doing 2+ jobs while in vmware is the smartest person. There was a post by him claiming that.

The States are technically oligarchic capitalism. It's embarrassing to conflate the two. Large corporations have a large amount of influence in the market, preventing direct and fair capitalism. OP's comment is not toward capitalism, but mega corporations that are allowed to skirt the rules to exploit employees for the benefit of shareholders. To translate your comment better: "If you don't like it, move to one of the hundred capitalistic countries that don't kiss corporations' as--s."

What ?? if impacted w get salary for only Nov & Dec ? This is already a very slow time for hiring. And from jan 24, we re on our own ? Thats so f***ing lame severance
Are you referring to RSU's that were granted over the summer? If you got say 10K, you will get 2500 cash regardless of if they vested? Would be nice if they accelerated RSU vesting as part of severance for any outstanding RSUs you have.

Dude, we are not getting 4 months base severance. The 2 months in the VMware policy is based on the WARN act.
Ok, I guess the comments about no WARN make sense because I have heard that layoff payouts will not be under VMware policy. In California, we'll get two months on the payroll in Nov & Dec and then the payout is 1 week for every year you've been with VMware, not to exceed 8 weeks. If you got RSUs this summer you'll get the 25% in cash. My source is credible and this is not the payout that I'd hoped for, unfortunately.
Based on how BC operates and avoiding 60 days of payroll will be consistent with their cost saving SOPs, here is a prediction based on our severance policy (go ahead and yell at it because no one can be 100% sure) -
60 day Pay in Lieu Of Notice (meets WARN requirements) + 2 months severance pay + 1 Week /year of service + 3-5 months of COBRA payments.
Uncertainty over 3 or 5 months healthcare is because our severance policy grants 3 months + Warn language says if they give pay in lieu of notice then it’s pay+benefits. So maybe 2 months extra COBRA payments
I firmly believe there will not be a full 60 day notice. Sorry H1B holders.

And btw, when you collect severance, you also promise not to sue them. The extra money is to save them from lawsuits.
Looks like quite a few have questions about the WARN act. The 60 day notice required by this act is what gives everyone the base 2 months severance. Broadcom can by law have us work those two full months. If they are just paying us and letting us go, isn’t that great? The additional one week per year severance is payment for loyalty to the company. VMware and Broadcom are not obligated by law to pay us even a dime for the years at the company. It’s just their good will.
If someone is trying to help by providing an answer to your question, snapping back at them doesn’t seem prudent. What we have in the US is the stated policy and that’s it. I’ve also asked the official slack channel about whether we see WARN period and then severance but no answers. I’m not an expert, but seems we would not if there are layoffs Oct 30 and we don’t have any WARN notice by now.
Can I just say how shi**y it is that in lieu of WARN we get the severance we would have gotten anyway had this not occurred? Yet another way these people bend you over and ra-e you. Save the "you're luck you're getting anything" comments.

The question is how it applies to the WARN act. This information is nowhere to be found. This is so annoying and unhelpful and doesn't answer the question.

As stated in other threads, there will be no WARN notice due to severance. As a few managers/directors have said (all saying the same thing), that everyone will get notified around October 15th (give or take a day or three) regardless of which bucket you are in.
