3M Huge Win Over Vets

Experts around the world estimated this defective ear plug product was a $8 to 25 billion liability. Vets now cheated with settlement of about 30 cents on the dollar. After legal fees each vet gets only 11k for hearing loss. How did this happen, let’s review how 3M beat some of the best and brightest MDL lawyers. 👨‍⚖️

First, 3M said that product was “safe and effective if used properly”. Was that honest?

Then 3M declared bankruptcy. Really, no money left? 💵

Then 3M said “Department of Defense data shows no hearing loss among vast majority of plaintiffs”. Effectively calling the vets liars.

Then 3M said their expert study showed $1 Billion would be enough and fair for vets with hearing loss. That was a lie. 3M did just settle for 6 times their original “fair” estimate.

A lot of 3M executives high-fiving this week. Stock price says it all. 3M says this settlement is not an admission of liability”. Really? Product was effective but you are willing to pay $6 billion?

3M is uncharacteristically quiet 🤫. For good reason.

Attention now shifts to PFAS pollution. 3M says that $10 billion is a fair settlement for polluting the planet’s water supply. This chemical is everywhere. The estimate for cleaning PFAS from US drinking water is $400 billion. 2.5 cents on the dollar is the offer from 3M. Is $10 billion really fair?

“Yes” says 3M. 🤥

Minnesota, where 3M is headquartered, estimates PFAS cleanup at $14 to 28 billion just for one state. 3M’s paltry offer will not even fix one state. 🧪🧪🧪👨‍🔬👨‍🔬👨‍🔬🏭🏭🏭

3M just cheated 300,000 vets. Will 3M be able to cheat 335 million US people out of clean drinking water? 3M’s brand is “3M Science. Applied to Life.” 3M’s internal documents on PFAS negotiation and misrepresentation says “COMMAND THE SCIENCE”. A professor who 3M paid bragged about burying the PFAS pollution truth.

PFAS MDL attorneys will fold for a quick settlement. 22 Attorney Generals stand for ethics, integrity and fairness. Will they fold to 3M? Tax payers will be on the hook.

I just completed a cursory scan of the Combat Arms Settlement Agreement (available in the public domain by the way) .

One very interesting section is that a portion of the settlement payment will be made in consecutive years using 3M common stock. There is an accompanying issuance formula, annual schedule, et al.

Cheer now, but 3M Company will file for bankruptcy protection, likely under Chapter 11. Once that occurs, your pensions and other forms of compensation are subject to change or elimination. So keep laughing… karma.

I have little sympathy for anyone in this mess and let me do my best to offend everyone.

No doubt that slimy plaintiffs’ lawyers are looking for a money grab. No doubt that the vast majority of plaintiffs were looking for some easy money as well. In that sense, 3M is getting screwed over. At the same time, 3M obviously didn’t do sufficient diligence in its acquisition of Aearo. When you acquire a company that sells products to “heroes”, you better make darn sure that there’s no warts in the diligence. Because if those “heroes” become plaintiffs on witness stand, you are going to lose, and lose big. 3M Company, its shareholders, and its employees learned this painful lesson. Finally, it should not be lost on anyone that all of this mess unfolded as a result of completely separate, objectively baseless sham patent litigation which 3M initiated in an attempt to bully an earplug competitor. It was through those proceedings that key 3M documents produced that became the centerpiece for the largest MDL in history.

IMO, there are no clean hands here, with the possible exception of a very small number of vets. I’m not so sure of that either.

I disagree this is cheating the vets. I have used the earplugs in the correct way at all times and almost got pushed into becoming another plaintiff by the law firms reaching out telling me I should file a lawsuit for my (non-existent) hearing loss. Two friends actually did participate in the lawsuit and have still not been asked to prove their claimed hearing loss. That smells bad and just lawyers making money to me.

Sounds like the vets got sold a fake bill of goods from their lawyers. At some point, the plaintiffs need to acknowledge they were used. You think your lawyers bought that beach house and new Porsche with their $11k cut? More like they get 30% of that 5 billion. Lawyers were the only winners in this.
