When will warn notice be posted in CA? Nothing yet and 60 days is required.

This time, feel like they pay two months severance in lieu of 60 days notice, reason? Nothing happen in 60 days as laid off employees are non productive, they can harm the existing projects.

Here is what the Department of Labor has to say on the 60 day notice and the payment-in-lieu-of-notice:

  • What if my employer pays me for the 60 days instead of sending me a WARN notice?
WARN requires 60 calendar days' written notice. The law makes no provision for any alternative such as pay in place of a notice. While an employer who pays workers for 60 calendar days instead of giving them proper notice technically has violated WARN, the provision of pay and benefits in place of a notice is a possible option. Because WARN provides for back pay and benefits for the period of the violation, up to 60 days, generally this approach by an employer用ay in place of notice洋eans that the employer has already met the penalty specified in the Act, if the payment is not required to be made. WARN allows voluntary payments of wages and benefits to be offset against any damages that might be awarded. If, however, a payment is required by another law, contract or company policy or practice, it may not be offset against WARN damages.

I think that they do not have to file it if they provide severance that's "at" or "longer than" 60 days...

Those notified will most likely remain on the payroll for 60 days, which means the WSRN notification won’t precede the layoff notifications

That will be in December. Those affected will be notified sometime in Oct, but will still be on the payroll for another 60 days which should fall in December. Last layoff in May was not published in WARN until mid July. So I assume they follow the same schedule.

WARN notice will be filed the day of layoffs as technically laid off people will still be on the payroll getting severance.
