Do you get your PTO balance paid if laid off ?

I live In Illinois and they are mandated to pay every hour I have. I work in Quest and can not imagine a layoff not coming. We have been slow for 10 months now. I am saving every hour of PTO I have
Cali, Colorado, Illinois, Louisiana, Maine, Massachusetts, Montana, Nebraska, North Dakota, Rhode Island, and Wyoming will be paid all accrued time, this is state law. Everyone else, only 40 unfortunately. I know someone laid off that got all accrued time in one of the states above
I was laid off on 8/10, and the separation letter clearly states they will only pay unused PTO up to 40 hours, so be sure to manage it.
I heard from someone laid off they got paid out 40 hours even though they had more. So I'd plan to keep no more than 40.

I try not to ever keep much of a PTO balance just in case. My co worker was laid off and they told her that her PTO would be on her final check and it was not
If you have a balance of 40 hours or less you get it. Anything over you don’t.
Depends on the state you live in. Somewhere around 7 states have state laws which force UHC to pay out accrued PTO. Might be in the severance policy.
From my understanding is that it's a no. I would use that up.
