Thread regarding CVS layoffs

Questions on Severance payout. WEEKS of Severance Paid out on SEMI MONTHLY cycle

Hi everyone.

Got the severance yesterday, and I think there may be an issue. I will be calling CVS, but doubt I will get a timely response.

Bear with me as this is a bit dense.

I am supposed to get 14 weeks per policy and the severance period would run from 10/22/23 through 1/27/24. No problem so far.

However, the agreement says pay will be in accorance with the companys regular payroll practices which is payment on the 15th and end of the month.

Let's just say my salary is $52,000 so we can keep the math easy. 14 weeks of pay would be $14,000. But as it is paid semi-monthly that is a rate of $2,166.67 semi-monthly.

There are pay periods on 10/31, 11/15, 11/30, 12/15, 12/31, and 1/15 during the terms of the agreement. So six total paments.

6 payments at a rate of $2,166.67 = $13,000. Or basically 13 weeks instead of 14.

Now if they paid a 7th payment that would be too much, but I don't trust that they will make an adjusted payment for the extra week on 1/31 since that is after the terms of the agreement, and the agreement is specific on the semi-monthly amount.

Thoughts? Am I over thinking this or being appropriately concerned?

The specific language is "at the semi-monthly rate of $X , beginning on 10/22/23 and ending on 1/27/2004 (the "Severance Pay Period").

That sounds to me like they aren't paying after 1/27!

Note this could apply to others with different lengths of payouts if your weeks don't line up with semi-monthly payouts.

That's what I would hope, but the agreement is pretty explicit that the term of the agreement is through 1/27/24

The remaining week would be paid out on your January 31st paycheck.
