Thread regarding Union Pacific Corp. layoffs

If you’re furloughed,

and you are a protected status of any type, file an EEO complaint on your way out. Also file a separate complaint with the federal EEOC. For example, if you are over 40 years old and they furlough you and keep anyone who is younger than you, regardless of if they are managers or someone younger than you is higher on the seniority roster, or even if they are a different craft but work at the same facility as you, file age discrimination. The company isn’t going broke, and if they want to make more money then let them work towards better operations, not just simply “cutting costs” by letting employees go. That will help bring attention to what Jimbo is doing.

Not if they are fired they can’t. If they are laid off then they can.

If a manager kept paying union dues to keep their seniority from their previous agreement job , if they are fired they can bump back to the old seniority district and keep working for Up.

What exactly is a protected status person? Filing an EEO complaint on your way out is a great idea, but the burden of proof is on you. Just like the last poster said, "get rid of the PSR and Jim Vena". Just doing those two things alone would solve a huge amount of problems for the company. I don't recall anyone saying the company is going broke but they do have a significant debt level. So what's the logic behind filing such a complaint? You file a complaint and then what? Even if you file a complaint and they offer you your job back, would you really want to go back after said complaint was filed? You would have the biggest target known to man on your back. Some people fought the company and won, only to be put into a management position to get them off of the seniority roster and fired from that management position with no chance of going back to the craft they left. That seems a bit farfetched, but I did see it happen. That employee then claimed retaliation, only to lose that fight because the company could show that no retaliatory action was taken. The UP can and will find any reason they can to get rid of people. They especially know how to get rid of people that fight back. I really wouldn't worry too much about shining any new light on the actions of the UP. Trust me when I tell you that there's many interested parties already watching what happens on a daily basis. It's not a bad post, but people better think long and hard about filing an EEO complaint against the company that wrote the book on dirty tricks.
