Declining BC Offer Letters - Can you elect Severance??

Does anyone know if you can decline a bc offer letter and just take the severance? My manager first said it’s seen as voluntary separation but now they’re not sure.

In other countries in EU if the offer you receive has some [notable] changes from your current work you can refuse the offer as the conditions changed regarding the first contract signed.

It's part of your rights. It all depends on the new contract.

Broadcomm will act on a country by country basis.

Because people are used to the comfortable, well paid life at vmware without any repercussions.

'Real' adult working life will eventually catch up with them.

It’s a valid question but the flaw is in the word used “elect” and people are eager to jump to conclusions that you were offered employment and you rejected it so why would BC pay severance.

Take step by step and you can see that severance could be an option. Say you receive an offer. We know it will be before 30th October. Say you don’t like the offer and you rejected it. It will still be before 30th October. That means you will still be a VMWare employee till 30th October who rejected an offer. BC will have no option but to lay you off. You get Severance. They cannot say that by rejecting offer you are resigning. You are not employee of BC when they make offer to you. By rejecting offer you are not resigning from VMWare. What will BC do on 30th? Think about it.

No. Typically you cannot “deny”
An offer to stay and get severance. I suppose you could ask them but during the CA Technologies acquisition (my experience) everybody who was asked to stay stayed and the if you didn’t want to stay you simply walked away with nothing.

The alternative is that you could go to your manager immediately and tell them that you’re not interested in staying and that if possible put you on the day 1 layoff list.

The nuclear option is to just accept the stay offer but not show up and just act like you don’t even work for Broadcom and move onto your next job and just let Broadcom terminate you whenever they want to.

As mentioned by the HR lady, working at BC would be a very different experience than at VM. What if the offer we receive from BC are totally different than the one, such as job title/role, WFH, benefits, we accepted from VM when we joined. An unmatched BC offer might be considered as a new job offer, rather than a renewal. Does it make sense?

Yes you can decline severance and instead ask that the state pay you severance.
Or to put it in terms that may be more understandable.

I believe this question has been answered numerous times by the International Slacker Comittee.

If I remember correctly, the answer was that, if you are an overperformer and would loke to get severance package, then you had to stop doing meaningful work effectively from June 2023 to catch up with negative feedback that DEI folks would get by default. Otherwise, you won't be qualified to receive severance package.

If you are underperformer, then you don't have anything to worry about.

Now is too late. But it is all your fault. Sorry!

They're not sure because this question has been asked repeatedly to leadership, in Slack and in All Hands. They are waiting for confirmation from Broadcom.

But think logically. Severance is for an unexpected loss of a job for when you're laid off. If you choose to reject a job, why would they owe you money? They wanted you. You made that decision, not them.

During SYMC acquisition it was not possible in the US... but they could not prohibit that in the EU so A LOT of folks just took the money and took off.
