Can I sue Qualcomm for discrimination?

In NJ Qualcomm gave 2 weeks notice for May 17th layoffs and the last paycheck was on Jun 1st. While laid off CA employees were allowed to stay on payroll till Jul 20th. The same WARN act applies for NJ like CA. The severance pay was also same between CA and NJ.

California rules are different. Even for holidays and vacation their rules are different. I don't work for this company but my company always sends out notice (example: This applies for all states but california ...) So check the laws in california before going ahead legally. You may just end up spending your own money on laws you don't understand by hiring a lawyer that will pocket your money after a few sessions just to tell you that the laws are different.

NJ wasn’t discriminated against, they didn’t receive the dame package as CA. Qualcomm isn’t required to provide the same package. NJ has never brought in much $$.

In CA, must provide 60 days advance notice, in NJ, ew Jersey, 90 days notice if 500 or more employees are affected.

Both states have exception clauses in cases such as unforeseeable business circumstances and faltering companies. Specifics differ.

There are WARN acts at the federal and state level. Depending on your state you could get less of a benefit. CA has very friendly employee benefits. You would need to look up NJ law and see if it matches CA. I can tell you right now they don’t. Maybe sue your state of not being as liberal as CA
