Recorded Without Consent

I was recorded in a meeting, I wasn't informed of it nor was I asked permission to do so. In the state I live plus Federal it is a violation of one's rights to record without them being aware. I have obtained an attorney and will being filing a lawsuit. My rights were violated.

Federally and in NY (my state) only one party needs to know about recordings.

Consent can come in many forms.

Many townhalls are recorded. Yet, with hundreds of people attending, they are not going to get consent from each individual person. They are not even required to tell you they are being recorded because someone else already noted simply by working there, you consent to be recorded.

You are not likely going to win a lawsuit unless you can prove it was for nefarious reasons or being used against you. It is just you against a behemoth. It will cost you more than the trouble it is worth. The behemoth always wins. Your lawsuit, if you truly are filing, will be quickly dismissed.

They have to have consent, that has been confirmed. They cannot just record without one's consent.

Pretty sure all meetings are recorded and they don’t need your consent to record company meetings. You day drinking again?

Was the recording part of a MS Teams meeting?

I believe company policy does state they have a right to record - and that is part of your employment agreement.

I have been recorded many times - both with and without me knowing it. However, because I know the agreement, it cannot bother me.

If you are a member of management and are lieing , abusing or violating company policies you deserve to be recorded. You can’t use the recording in a court of law but you can let an attorney hear it and he can tell you what to do next. A lot of supervisors scream and insult employees and then lie about what happened . If you report it HR will lie and never admit to the company doing anything wrong.
