Just guessing, I would think H1B workers are equally or more at risk. The entire approval process of an H1B visa hinges on the fact that it can’t take an “American’s” job (LCA)

I dont think so , unless you have a confirmation from someone or have a solid reasoning of not doing it.
Imo an employee is an employee irrespective of visa status.
