Thread regarding Optum layoffs

Warn Notice

Curious as to why I can find nothing when I look on MN’s Warn Notice for United or Optum-I thought they were required to report there??

WARN act requires a location specific layoff. As so many are remote, no WARN act requirement. Quite the loophole for a company that is so remote and does so many layoffs.

The only ones I’ve seen are those that impact a specific site (closing down a site, etc.).

I think in previous ruling that there is a loophole if the designation is if contractors are being fired they don't count as "company" employees there for not having to report to WARN Act.

IT makes no difference whether you signed a severance package or not
You cannot "Sign-away" a right
If the WARN law indicates you are entitled to 60 days notice before layoff (And we paid for those 60 days), it makes no difference what you sign, you are still entitled to the 60 days notice and money

Just because a company fails to comply with the WARN Act, doesn't mean they will get away with it
You should file a complaint with the Federal Department of Labor (DOL) so they can look into the complaint, particularly if a company has employees in many states. The DOL has the authority to enforce the law in all 50 states
You should also file a complaint with your State's WARN agency so they can also open an investigation.
