What are the consequences if I was laid off and I go to work for a competitor prior to my one year post layoff? Would CDK sue me? Any suggestions? Thoughts? Feedback??

If you're laid off and offered severance, part of accepting the severance is signing another non-compete.
If you live west coast or in some east coast states nothing will happen to you due to non-competes being illegal for non executive jobs. They might cut off any severence you have coming if it hasnt been paid out yet, knowing that you cant afford a lawyer to fight back for it, but otherwise thats about it.

um, you mean that the core products are running on technology developed in the 70's and are held together by chewing gum and duck tape that is put there by people who are retiring every other day?
CDK cannot deprive you of the right to make a living. Non-competes are extremely hard to enforce and not worth their time to pursue. You just need to be careful not to divulge any of CDK's trade secrets to your new employer. It's not only wrong, but it could lead to a lot of grief for both you and your employer.
From what I have heard the NDA is null and void if they fire or lay you off. It only works if you quit and there is a time limit to it and it had to be signed when you got hired or before.
From what I've heard, If they find out, and you're still getting severance, they'll stop the severance.
Once you are laid off, any non-competes and very likely NDAs you've signed are null and void.
You can work where ever you want. Once CDK lays you off that results - null and void of any non compete if you signed one.
