Legality of New Sales Comp Plan

I realize the USA is 30-40 years behind other countries in terms of protecting employee rights from abusive and unfair working conditions, but has anyone looked into the legality of this new comp plan? Is it even legal?

Dell gives sales an advanced payment (draw), during month 1 and 2 of the quarter, which corresponds to a certain % of the total commission (at 100%).
Once they do the calculations, if the actual commission accrued is lower, the sales person carries a negative commission which will be deduced from the next quarter one. And so on, until you make a commission high enough to be in the green area.
If you leave or are laid off, that money is deduced from salary or anyway you must return it.
And there is no way to opt out from draws, so the company is forcing you to accept the advanced payments without you even being sure you earned that money.

The new plan does not make the sales team trust the company... at all. It's too complex and with quotas being given well after the backlog is calculated it only makes us suspicious that they're just scamming us all the time. With this new setup it's just going to result in angry people and probably a bunch of lawsuits Dell will have to settle due to mistakes, etc. Once the suits hit the presses all good will is gone, if they have merit or not. This is just complexity for complexity sake. Really silly.

I'm in EMEA and we got the SCP presentation today. Roll-out is no-go for African countries and some major EU ones, temporary no-go until discussions with unions/labour committees lead to an agreement in several western EU countries, immediate go in Switzerland and Eastern Europe (except for Poland).

No one seems to be addressing the so-called “quoting” process or how it actually ties back to the compensation plan. Can someone clearly explain how Dell is setting quotas this year?

I would love for a law firm to take a look at the comp plans (current and past). How about also looking backwards at how the margin plans worked. They didn’t show the full margin, finance admitted that, so if we had a margin plan and they hid part of it or set flat margins like services then we are owed more than they told us. The current plan seems crazy as well, smart price changes on a whim, quotas on backlog with 90+ day lead times. It’s all nuts.

I think it becomes an issue in sone countries once we accept our quota.Once this is accepted we basically have a contract and have signed terms.

It sure doesn’t feel like it is legal. The fact we don’t get quotas until 4th-6th week on average, lead times put us at 6-8 weeks beyond that (minimum). With those time lines, we are either A. Shipping next Quarter, or B. Receiving quotes AFTER sales, or C. Both.

This allows compensation teams to give us quotas in hindsight for any given quarter. It’s a scam.
