Thread regarding ExxonMobil Corp. layoffs

Almost over, failing pip and ready to go at 50. They got me five years away from retirement.

Ok the pip plan was to improve me so me could stay supposedly. At my pip meeting last week I was told I was failing and I could take the PIL for one month that is left. I asked if I worked real hard and tried could I pass. I was told there was no way I could recover and pass. All my coworkers have distanced themselves from me and I am an outcast. My end date is at the end of November so I guess this is the end. There reasons for me not passing were insignificant and meaningless. My manager is a coward and only told me I was failing at the end. I told them I thought pip was supposed to help you improve and stay. I am being forced out and isolated. The manager told me why would you want to stay where are not wanted or liked. They want me to quit and sign a separation resignation letter. I told them no. I am ready to go and will start looking for a new job in 2026. It is evil the way the piped me at 50 years of age so I cannot get my retirement. I believe I can get my lump sum but it is heavily discounted.I was 5 years away from retirement but now have to look for a new job. Be careful they are heavily targeting 50 year olds. I and another 51 year old are being forced out this year. My pip was impossible to pass.

Mediocre is the norm at exxon. I have seen the most clueless inept supervisors and managers at exxon. Star employees that know nothing and do nothing. Id--ts that almost ki-l employees that are promoted. Safety violators' that are protected by their friends. Employees that complain they are not paid enough. Lots of tu-ds at exxon that excel and survive the games.

If you are my manager then spill the beans on what I did not do. None of the management at exxon has ever been professional. They have been professional a holes but that is all. Please dont lie and say exxon HR and management is trustworthy, honorable or fair. I did what was wanted and on the pip but bit was never enough. The game was fixed and I was destined to fail.

Let me say, there are two sides to every story. I could share the reason for the pip and what you have (not) done since then, but that would not be professional.
Bottom line, just like your kids feel like they don't deserve the consequences you dish out at home, we have some people here who think mediocre is perfectly fine.

Yes they are trying some very underhanded tactics to get me to leave resign. I have been bugged for the last two weeks to take the pil and leave. If they would fire me it would be better.

The Standard of Proof in Texas: To prevail on an age discrimination claim, a plaintiff must show that age was a "substantial motivating factor" in the employer's adverse employment action (which in Texas is generally seen as a more favorable standard for the employee than the federal "but-for" standard). The facts you describe would certainly allow an experienced litigator to argue that the desire to clear out higher-paid, older workers close to full retirement was a substantial motivating factor.

You were asked to "quit and sign a separation resignation letter." Your refusal was the right move. If you had resigned, the company would argue you left voluntarily, which can significantly complicate or even bar certain claims and unemployment benefits.
The fact that your manager created a situation where you were isolated, told you were failing a no-win PIP, and told you, "why would you want to stay where are not wanted or liked," all while pressuring you to resign, amounts to what the law calls "Constructive Discharge."

What it Means: In Texas, courts treat an employee who is constructively discharged as if they were involuntarily terminated by the employer. This allows you to pursue remedies for wrongful termination and is essential for an unemployment claim. You did not quit; you were forced out.

You need to "bring the paper", documents everything. Time , what was said by who.ect.
Do not sign anything
Time is Limited: To pursue an age discrimination claim, you must first file a Charge of Discrimination with the EEOC (Equal Employment Opportunity Commission) or the TWC Civil Rights Division within a strict deadline (generally 300 days from the discriminatory act, which is usually the date you are notified of the termination). This is a legal prerequisite.

Contact a lawyer . And enjoy the settlement offer.

They don't want to fire. They want me to volunteer to resign and separate from the company. I asked them would I be fired and they said only in extreme cases does exxon fire employees. They prefer to use pip I think it's better to get fired. I sure do want to tell these b as yards off and tell them to stick k it up their arese. It pi---s me off that I am so close to retirement. I have seen employees blow up pipes and have saftey violations but they are still employed and will retire. Meanwhile I have never had a saftey or discipline write up. My work has been good and it's only my pay and age.

You folks are better people than I am. I would hunt that supervisor down and beat their a-s. But I would have nothing to lose either. EM is like anywhere else in the working world, hard work, loyalty and dedication gets you nowhere anymore, but if you play the “games” just right and kiss the right person’s ba--s, even the shittiest employee will have endless opportunities, I’ve even seen EM create an advanced position for someone.

@OP PIP is to force you out of your job and provide legal cover to the company while they do it.

Different companies use different tactics. On the tech side, they’re blaming AI for layoffs but the jobs themselves aren’t being automated - they’re being sent overseas. Oil companies can’t really use this as an excuse so they just do PIP/RTO and other BS to force resignations. If you don’t quit they just make up a random a KPI and fire you for not meeting it.
