@1ey Agreed with the dysfunctional management who are only concerned with their own portfolio. The culture that built NetApp has disappeared with the migration and hostile takeover of VMware disgruntled employees 3.5 - 4 years ago!! RIP NetApp!!

@1dm 100%, correct!!!! Why hide behind the bogus “needs improvement” ranking during an incredibly shady NEW review process???

@OP I was laid off on Tuesday September 23 due to “operational restructure”. How many others were laid off this week? Are more layoffs planned in October?

Saw a few posts on LinkedIn. Looks like SDR team and one in Customer Success (so far that I am aware of). Only noticed AMER impacts. Sad!!

They must pay you out of your "earned" PTO! This is from ChatGPT. I even ran the NetApp layoff PDF's though it.

Here’s how it breaks down for your situation:

  1. PTO vs. FTO

PTO (Paid Time Off): You “earn” hours as you work. By law in California, earned PTO is treated like wages.

FTO (Flexible Time Off): No hours are accrued—time off is at manager discretion. Because nothing accrues, there’s nothing to cash out when you leave.

  1. California Law

Since NetApp is headquartered in California, California labor law applies.

Any PTO hours you already accrued before the switch to FTO (your 200 hours) are considered earned wages.

Employers cannot take away or erase those hours by changing policies.

  1. What Happens at Layoff

You must be paid out for all 200 hours at your current hourly rate when your employment ends.

That payout should show up on your final paycheck or a separate payout check.

  1. What to Do

Review your separation paperwork and final pay stub. Look for a line item like “Vacation Payout” or “PTO Cashout.”

If it’s missing, HR or payroll needs to fix it—they are legally required to pay it.

If they refuse, you can file a claim with the California Labor Commissioner (DLSE).

Here it comes. Leadership is so dysfunctional that they could not even manage the layoff correctly, and it got delayed. By the end of this week!

@a2 Stacked ranking is a scam. Just like senior management.

@g2 pushed a few days. Still hearing this coming week. But I don't know any managers who had the "Call" where they train how to deliver the bad news. myself and other leaders got the "rank your people" message from Leadership and told us this time frame.

I think its in PM and Engineering, latest word on Sales was end of Oct, right before Q3 starts.

@pv

I don’t think it works like this legally. PTO stops accruing in Oct and people are encouraged to spend it and be converted to FTO, but until they spend PTO, they are entitled to it.

@k8 With a late September RIF, it is unlikely that there will be any PTO payout. If the layoff is sufficiently large (i.e. triggers a WARN notice), you would still technically be an employee for another 60 days (and paid for it, but would not officially work). This would put you past the October FTO cutover date, therefore, no PTO to be paid out.

Will PTO saved still be paid out? My understanding is yes?

@g2 Nobody knows for certain. Rumors suggest a layoff is targeted September or first half of October. After the artificial and pressured burn down of banked PTO, leadership plans to reduce the headcount by an estimated 3.5-4% and target a mix of technical, sales and management roles in western offices.

Here's hoping these rumors are unfounded.

@em of course not. This is a site called thelayoff, so people post here every few weeks so that once there is an actual layoff, someone can say "See, told you so!"
