Is anyone else who was laid off considring legal action??? I feel like I dont have much choice but to accept the severance package they offered, but I’m wondering if anyone has successfully challenged it in court or negotiated for a better deal.

You do have a shot, all of us have a shot, look at all of this:
- HP Inc. / Hewlett Packard Enterprise – $18 M Settlement (2023)
Employees aged 40+ filed a class action in Northern District of California, alleging layoffs specifically targeted older workers. A judge granted initial approval of an $18 million ADEA and state-law settlement.
- AT&T – Confidential Settlement (c. 2022)
A former manager led a proposed age‑bias class action after group layoffs claimed employees over 40 were disproportionately affected. AT&T reached a confidential settlement to resolve the class claims.
- IBM – Age-Bias Class Litigation Resolved (2025)
Sixteen former employees alleged they were fired to make room for younger hires. Filed in New York federal court, the ADEA class action was settled, though terms remain undisclosed.
- X (Twitter) – Class Claim Certified (2024)
After mass layoffs under Elon Musk’s leadership, a San Francisco judge ruled that 150+ workers aged 50+ had viable class grounds to sue for age discrimination under ADEA.
- Jet Propulsion Laboratory (JPL) – $10 M EEOC Settlement (c. 2020)
The EEOC charged JPL with disproportionately affecting workers over 40 during workforce reductions. JPL agreed to a $10 million settlement and implemented injunctive relief and monitoring.
- X (Twitter) – Zeman v. X (2022 layoffs)
A federal judge in San Francisco allowed a class-action to proceed, finding older employees were disproportionately affected:
"60 % of workers aged 50+ and nearly 75 % of those over 60 were laid off, compared with 54 % under 50."
Judge Susan Illston ruled that plaintiffs showed sufficient evidence for age discrimination to proceed collectively.
- Detroit Tigers – Pellant & Johnson v. Detroit Tigers
Two scouts (ages 68 and 67) sued MLB’s Detroit Tigers after being terminated following the 2020 season.
They alleged age-based disparate treatment tied to an analytics-focused shift. The case is ongoing and highlights post-layoff age bias patterns.
- Covenant Woods – Receptionist EEOC Settlement
A 78-year-old receptionist was fired shortly after a health incident. She won a $78,000 settlement through an EEOC age discrimination claim.

i also considered it because i was supposed to leave for paternity loa very soon but since being laid off , it seemed possibly retaliatory but my attorney friend said no because it was part of massive layoffs it would be hard to prove
I was thinking about it but then I felt I'd be tied to sharp forever, i just want to have a clean cut and do not want to turn around a think about sharp at all.
i know everyone is different but this is how i am coping with this. i am almost 55 and i am certain i was plucked out just because of my age, so i'd say i had a shot at pushing it in that direction but whatever.
still bitter - very bitter - but it's time to move on after 20+ years
