Thread regarding Optum layoffs

WARN ACT - please read this.

The Worker Adjustment and Retraining Notification (WARN) Act is a Federal law that says that your employer
must give you 60 days written notice before you are laid off, and they must pay you for these 60 days.
The WARN money is in addition to any severance payments you may be entitled to

In many states, there is also a state version of the WARN law

Federal WARN ACT
https://www.dol.gov/agencies/eta/layoffs/warn

Minnesota WARN ACT
https://mn.gov/deed/business/starting-business/basics/plant-closings.jsp

If your employer fails to provide the required 60 days notice and pay you for 60 days, you may file a complaint
with the Federal
Department of Labor (DOL). You may also file a complaint with the state agency that enforces this law.
For example, if you live in Wisconsin, type
Wisconsin and Warn ACT in any search engine to locate the Wisconsin agency

If your employer does not give you 60 days written notice before a layoff and does not pay you for those 60 days, your employer may be violating the Federal WARN Act. The WARN money is in addition to any severance you may be entitled to.

If a large number of employees are entitled to the WARN notice (and money), you might need to contact an attorney who specializes in the WARN Act. You can type WARN Act and Minnesota for a list of attorneys in any search engine

UHG and Optum know the number required per state and stay under that number in each state every round to avoid having to issue WARN notices. That is one reason there are numerous rounds of layoffs.

Using this site, you can specify an employer's name to determine how many employees of a particular employer that were laid off in the past 60 months. This is just an example for Illinois. If you live in Minnesota, for example, type this into any search engine: Minnesota WARN notices (the word "notices" must be specified in your search criteria.

You should check the state WARN web sites listed on this site because, in many cases, your employer already notified your State office of a future layoff before the people being laid off know about it. You can find these notifications on these web sites

If you live in these states, please learn something about the WARN Act whether you have been laid off or not. Just because a law says an employer is supposed to give to 60 days notice and pay you for the 60 days before they lay you off, doesn't mean the employer will follow the law.

You can learn more about the WARN Act here. There is a Federal WARN ACT and most states have a state version of the WARN ACT. As a result, you can file a complaint with the Department of Labor (DOL) for the Federal law and whatever agency enforces the WARN ACT in your state.
