Sue them? You have zero legal rights in terms of employer-side productivity monitoring apps, of which CapOne uses several. From badge swipes correlated to minimum on-campus WiFi use (ensuring no swipe in and leave), key monitoring, mouse mover detection, recorded calls, zoom transcripts and chat history scanning, there are a host of things in place to ensure you are working and abiding by the code of conduct.
It’s what they DO after the evidence they will present to you that may be a legal grey area. You may get a conduct memo or they could just axe you for cause on the spot. Remember Capital One operates out of Virginia, a right-to-work state which affords significant liberties to the employer to broadly monitor employees. But there may be some trailing legal precedents not cleaned up from the merger yet that protect you (for now) making monitoring tool evidence inadmissible in a conduct scenario. Either way, they will still find a way to ensure you are either working or gone through other means.
If you like your job, just play by the rules and do what you are paid for. Easy
If you have been one of the people fleecing the company, you can always roll the dice but it’s just a matter of time until you’re found out. There are several dozen, if not hundreds of applicants for every single open role. May be a world crash to hear this but you, all of us, are replaceable and they don’t want to pay a wage to people actually working (and not committing fraud by stealing time and lying idle). Would you pay your water bill if they shut off the water and still sent you a bill?
