Question about Dell files

I had my WFR meeting this morning and am reviewing HR material. I already emailed myself about a million files before I realized I was not supposed to (I thought this was OK as long as they were not marked confidential); how big an issue will this be for me?

Like a previous commenter mentioned below, I actually had to request to take some personal files off my work pc via usb. After a couple of days a response came back with a list of work related files in my personal directory I had to delete before they would allow. My point is they totally have reasonably quick access to every file movement and content.

if you knew the procedure you can https and transfer the files out to a site you control. Lots of sh-t goes right through those symantec proxies, they sux too.

if there is no rule in the dlp software to highlight these files or content...no sweat.

I wrote the long post down below. Dont want it to get lost in my rambling that my opinion is, yes, nothing may ever come about it.

Just wait it out and you should be good. If they make a big deal - then just make sure you dont let them bully you - nothing was done nefariously and they've done way worse - the amount of litigation risk and class action-esque things they've done recently....

There was a recent email or inside dell message about transferring personal data from your laptop and OneDrive. (Don’t forget OneDrive).
I don’t tend to keep personal data on my laptop

I only deleted personal files and kept any work related content on my laptop.

Just wait out.

a couple of things - from experience

  1. ) an investigator will call and instruct you to preserve the files for review in a shared screen session to determine next steps. in my case - deleting the files, emptying trash and reformatting the HDD and then allowing the investigator access to the HDD to review if the files were transferred or accessed before the shared session.
  2. ) severance was to be delayed until case closure
  3. ) I finally consulted an attorney and was informed that Dell's action was against the law violating my rights BUT fighting would have had affected severance BUT we could file suit.
  4. ) Outcome would vary because the files would have been proven taken against policy BUT this does not allow violating rights and making threats and illegally accessing my property (HDD) and privacy violations
  5. ) Attorney suggested we could settle for 2-3 times severance and after legal fees I would be maybe twice severance BUT it could take a long time and Dells plan would be to Counter Act enough to make it painful an necessitate settling for almost nothing - all along they wouldn't terminate me until case closure so state unemployment assistance would be prevented.
  6. ) In the end - I acquiesced - turned over my HDD with my company issued hardware - severance came through eventually.
  1. . My suggestion - WAIT it out. Dont go into that email - so no history of accessing files, viewing files, deleting files, moving files etc... Consult an attorney upon having an investigation session so you know your rights. And fingers crossed just nothing happens and separation is straight forward.
